Newly diagnosed, 16 yrs old and Fired from job! Help!

Sun, 01/09/2005 - 13:17
My daugther has been employed at our local quick shop for six months. I have been approached on numerous occasions, by people in our community, with compliments on my daughters exceptional work abilities! Recently after two seizure episodes, her boss (the owner) told her that her co-workers were uncomfortable working with her as a result of her seizures. She has permanently been removed off of the work schedule. Is this not illegal? Is this not discrimination? Does the ADA of 1972 protect teen agers? She has been working to buy a car.....postponed, she has been working to pay off an expensive class ring (she is  a junior in high school).....postponed. Talk about putting your life on hold! She has been taking seizure medication, and has not had any recurrence...... The seizures are difficult enough, a clear set back for a 16 yr old. Her brother has epilepsy.  This seems to be cruel.  I am sick and angry as their mother..... Do people have no consideration, compassion, or concern? This is the only place in town that can provide employment for a 16 yr old.  I am raging, if anyone has any advice I could sure use it!!  Thank you in advance.

Dear Shelly,

I have responded to a number of other threads on this same issue so I feel compelled to respond to you as well.  No - it isn't fair - but it is what has happened.  Why and What now?  There has been some good advice given already.  People are afraid of what they don't know or understand - so fix that.  It sounds like that is the case you have - a lot of unknown and fear about what to do, how to do it and why.

I have lived with this for over 30 years now and I have never had an employer or co-workers that did not work with me.  It has a lot to do with how you approach it.  Odviously you want them to want to keep your daughter employed - not be forced to keep her by law.  Explain everything to the bossand provide some printed information he/she can pass on to the other workers.  It is apparent others have enjoyed her personality and professionalism - and that is what keeps customers coming back to certain locations - price isn't everything.

If she does need to seek other employment (and it is out there) have her go prepared with information.  Provide it up front....along with the information that her seizures are under control, less frequent or whatever the case may be.  Cafes and restaurants are always in need of good help and can also hire 16 year olds - especially for the after school hours.  The work is good and a good waitress can make very good tips!  Department stores also hire teens as do grocery stores....she is certainly not limited to working at Quick Shops.  Have there been any problems at school?

You have 2 children with the same condition.  You will face a lot of misinformation and misconception as to Epilepsy by the general public in the years to come.  You need to educate yourself on how to comfortably handle situations and people.  You need to become your childrens advocate and an educator of the public on their behalf - and they need to learn how to advocte for themselves as well.  Contact your nearest Epilepsy Foundation office for information, literature and guidance.

Wishing you all the best...............Lee

I have something to say about anyone who gets fired from a job, or is turned down from any openings at a place of work due to them having epilepsy.  Believe it or not, it is against human rights to fire anyone for that reason.  If something like that should ever happen at a large place of business, all one has to do is go to the human resources department and file a complaint for that reason.  Mind you they will probably look for anything that they can do to get rid of you, but it is still not a valid reason.
