Driving while waiting for DMV

Last year my son had a seizure and the doctor reported it to the DMV. The doctor told him that he could not drive until he heard from the DMV. It's been over a year now and he never heard anything, however he did start driving on his own while waiting during this time. Last week he had another seizure after being seizure free for eight months, and again the doctor said the same thing, "don't drive until you hear from the DMV". My question is- isn't the doctor releasing his liability in case there's a car accident caused by a seizure? The doctor can't really remove his license. My son has a license until The DMV takes it, right? I guess her point is for the time he has to wait, approximately three months from what I've been reading, then they decide and then it's another three months? Provided everything is clear and healthy
