Introduction

The Epilepsy.com website located at www.epilepsy.com (the "Site") is owned by the Epilepsy Therapy Project. The Epilepsy Therapy Project ("we," "us," or "our") is strongly committed to respecting and protecting your privacy. Please carefully read the following Privacy Policy.

Any person accessing, browsing or otherwise using this Site, either manually or via an automated device or program, shall be considered a "User." The purpose of this Privacy Policy ("Policy") is to explain the type of information that we collect from our Users, what we do with that information, and with whom we share this information. By accessing, browsing or using the Site, you agree that you fully understand and consent to this Privacy Policy and all other terms relevant to your use of our site, including our Terms of Use.

The Information We Collect

We may have access to the following categories of information regarding you and your visit to the Site. Only some of these categories of information identify you directly, but each category offers some information about your interests and activities that could be used to make inferences about you.

Personally Identifiable Information/Site Registration

Epilepsy.com is designed so that you are not required to provide any personally identifiable information unless you are requesting access to certain features and services or you are voluntarily submitting personally identifiable information to us. Personally identifiable information may include a User's name, address, telephone number, credit card number, e-mail address and any other personal information that could be used to contact or identify you that you provide through the Site to us, our employees or agents, via e-mail or otherwise. This also includes personal information that you provide to us by mail, such as a donation. When this information is combined with any information about your health or medical condition, we refer to the resulting information as health-related personal information.

The Site may allow you to register yourself to access certain pages or services. For example, the My Epilepsy Diary feature enables patients to register at our web site where they can create an individualized profile, which may include information relating to their experience with epilepsy including seizure episodes, medications and side effects.

Publicly Viewable Interactive Services Including Blogs, Chat Rooms, Community Forums
Any communication that you submit or that may be posted to any publicly viewable interactive feature such as blogs, chat rooms or other services is a public communication and may be viewed by the general public. Therefore, you acknowledge and understand that you have no expectation of privacy or confidentiality in the content you submit to such services over our Site, whether or not it includes personally identifiable information about you. If you display your personally identifiable information in any communication or post submitted to such services or features, other individuals may collect and use your personally identifiable information. While we may remove personally identifiable information from posting to our Site, we assume no obligation to do so. We do not require you to disclose personally identifiable information in these forums, but apart from warning you to be prudent in your statements, we do not have the ability to control your disclosure of private information. Anonymous Browsing Information

Users can browse the Site without revealing personal information. Through the use of cookies (see below) and other techniques, our servers may collect your Internet Protocol address, your computer's operating system, the name of the domain you used to access the Internet, the website you came from and the website you visit next.

  • IP Address. We record the Internet Protocol (IP) address of your computer when you visit our site. Without more, the IP address does not identify you personally, but it is what allows us to maintain communications with you as you move about our site.
  • Cookies. Like many other web sites, this Site may use cookies. A cookie is a piece of numeric data that is sent from an Epilepsy.com web server to a User's web browser and stored on the User's hard drive. This is typically done to recognize you and help us to understand the way our Site is being used. Personally Identifiable Information. The Epilepsy Therapy Project uses the personally identifiable information collected from its Users to contact you confirming your registration with the Site, respond to your questions and/or comments, process a donation, fulfill a purchase request and notify you of your order status, provide any services or information that you request through the Site. Upon your request, we may also provide you with information about epilepsy that we believe would interest you, such as information from the Epilepsy Therapy Project, or provide you with information about important functionality changes to the Site.

Health-Related Personal Information. If you choose to participate in our interactive services, we will collect the information you disclose to us and analyze it to discover new facts that could help us better understand how our services are used in coping with epilepsy. We may offer interactive services such as the My Epilepsy Diary that involve health-related information. We may combine, in a non-identifiable format, your health-related information that you provide with information from other Site users to create aggregate or summary data that we will use for our organization’s purposes and to support our mission, including research to improve epilepsy care and analyses that may help us offer better support services.

Anonymous Browsing Information. We use your IP address and data obtained through use of cookies to customize your Site experience. Anonymous browsing information also may be used to gather broad demographic information used in marketing, promotion or similar activities. This information may be aggregated to measure the number of visits, average time spent, page views and other statistics about Users of the Site. The Epilepsy Therapy Project also may use this data to monitor Site performance and to make the Site easier and more convenient to use.

Who We Share Your Information With

We will not sell, share, trade or give away to third parties outside Epilepsy Therapy Project any personally identifiable information that we collect or receive regarding Users of Epilepsy.com without the Users’ permission except as explained below:

  • We may disclose personally identifiable information to our affiliates, business partners or others who work for us such as service providers, vendors, contractors and agents when providing services on our behalf.
  • Epilepsy Therapy Project may provide to others aggregated statistics about our Users' site activity for purposes of research, marketing, promotion or similar activities. None of these statistics will contain personally identifiable information.
  • We may disclose personally identifiable Information to government officials and law enforcement agencies when it is required by law (e.g., in compliance with a subpoena or court order) or if we have a good faith belief that such action is appropriate and necessary to respond to claims, or to protect the rights, property or safety of Epilepsy.com and its Users, the Epilepsy Therapy Project or others. We may also share information with the government even without a request pursuant to regulatory reporting requirements.
  • In the event that Epilepsy Therapy Project decides to sell all or part or its assets, we reserve the right to include the information we have about you among the assets transferred to the acquiring company.

Applicable Law/International Issues

Information that is submitted to this Site will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. law. If you are a non-U.S. User, you acknowledge and agree that we may collect and use your Information and disclose it to other entities outside your resident jurisdiction, as discussed in "Who We Share Your Information With" above. In addition, such Information may be stored on servers located outside your resident jurisdiction. U.S. law may not provide the degree of protection for personal information that is available in other countries. These hyperlinked websites, may contain privacy provisions that are different from those provided herein. We encourage you to review the privacy policies posted on those, and all third party web sites. You acknowledge that links to third party web sites are provided for your convenience only and do not constitute an endorsement by Epilepsy Therapy Project of such third party web sites. Epilepsy Therapy Project is not responsible for the collection, use, or disclosure of information collected through these websites, and Epilepsy Therapy Project expressly disclaims any and all liabilities related to such collection, use, or disclosure.

Children's Privacy Protection

Epilepsy.com is a general audience web site not geared towards children. We are committed to protecting children’s online privacy and this Site does not knowingly collect any personal information from children under the age of 13. If you are under 13, you agree that you will not provide personal information about yourself to The Epilepsy Therapy Project through the Site. Please contact us at the email provided in the “How to Contact Us” section of this Policy if you believe we may have collected information from a child and we will work to delete it.

Your Privacy Choices

We would like to send you information about our organization and our services if you wish to receive such information. When you register on our Site, you will generally be given the choice to “opt-in” to receiving such information from our Site, but if opt-in choice is not provided, you may opt-out of promotional communications at any time. If you wish to stop receiving e-mail or postal mail from us or to have your personally identifiable information removed from our Site, you may send an e-mail to Webmaster@epilepsytherapyproject.org.

California Privacy Rights

California residents have a right to request certain information regarding our disclosure of the resident’s personal information to third parties for direct marketing purposes including when you specifically permit the disclosure. To prevent unauthorized access, maintain data accuracy and ensure proper use of your personally identifiable information, Epilepsy Therapy Project and its partners have appropriate physical, electronic, and managerial procedures in place to safeguard and secure all information we collect online, consistent with industry practices. Epilepsy Therapy Project makes no representations or warranties with regard to the sufficiency of these security measures. Epilepsy Therapy Project shall not be responsible for any actual or consequential damages that result from a lapse in compliance with this Policy as a result of a security breach or technical malfunction. Internet transmission, including e-mail transmission, is not secure and as a result, we cannot guarantee the security of our database, web site or services, nor can we guarantee that the information you supply or that we send to you or on your behalf will not be intercepted while being transmitted to us over the Internet. We are not responsible for the actions of third parties.
