Newly diagnosed, 16 yrs old and Fired from job! Help!

My daugther has been employed at our local quick shop for six months. I have been approached on numerous occasions, by people in our community, with compliments on my daughters exceptional work abilities! Recently after two seizure episodes, her boss (the owner) told her that her co-workers were uncomfortable working with her as a result of her seizures. She has permanently been removed off of the work schedule. Is this not illegal? Is this not discrimination? Does the ADA of 1972 protect teen agers? She has been working to buy a car.....postponed, she has been working to pay off an expensive class ring (she is  a junior in high school).....postponed. Talk about putting your life on hold! She has been taking seizure medication, and has not had any recurrence...... The seizures are difficult enough, a clear set back for a 16 yr old. Her brother has epilepsy.  This seems to be cruel.  I am sick and angry as their mother..... Do people have no consideration, compassion, or concern? This is the only place in town that can provide employment for a 16 yr old.  I am raging, if anyone has any advice I could sure use it!!  Thank you in advance.

Your daughter has been discriminated against. She has rights which prevent her ifrom being discriminated against due to her disability. The law requires that 'reassonable accomodations" be provided. In this case the accomodation may be that her co-workers and supervisors are educated about her condition and what, if anything, they would need to do should she have a seizure on the job.  They should also be educated about potential post ictal states. If she does have a siezure on the job, you might want to work out ahead of time issues related to being paid(or not)  for the time she is seizing and the duration of the post- ictal state.  This is a good time for your daughter to begin to learn more about her condition and to begin to develop self-advocacy skills that she just might need in future situations related to educational and professional pursuits. To learn more, contact your local  or state Protection and INformation group. In Texas it is Advocacy Inc. Every state has a P & I as they are federally mandated and federally funded to ensure disability  and civil rights under ADA, IDEA are enforced in the state. Good luck.

My name is 'Tracey',,& I Truly know what it's like . The way you 'Daughter' is being treated is definately a discrimination.If I were you , I would mabe go to a 'Lawyer' & get some advice,,because I did once before & then took them to court & won. If you don't mind,,I would like to keep in touch with you 'MORE' often. seriously, I know how your daughter feels,.I went, (& still do) through the same things she is now. I still get 'kicked out of' Restaurants,stores, you name it. I even have (so-called) family members that 'don't like to be around me when I have these episodes'!! And to top it off, would you believe that I 'CAN'T' even get 'Disability' because they DON'T consider 'Epilepsy' a 'disability'. Like give me a break. Anyway, If  you would like to keep intouch, PLEASE let me know,,,I'm here 'ANYTIME' you need a 'Friend'.

hey shelly, yeah thats descrimination, you nor your faimly has to take that crap! you need to go talk to the manager and owner of that place, im 19 have had epilepsy since i was 9 months old and i have been through alot of descrimination. life isnt that easy buy you ust gotta be optimistic about, epilepsy in my life has made life pretty hard for me but i have always managed to pull through, im working now and going to college. im actually going for my doctorit in psychology. but with the descrimination problem its somthing you will get use too, everywheres you go it will happen. the best thing you can do is let everyone that you work with or are around alot know about your disabilty ahead of time and tell them what they need to do if it occurs. o and you should talk to your kids doctor about a camp called camp cho-yeh. its a really fun camp ive been going there since i was 6, you meet other kids with epilepsy and relate to them and they also teach you all about epilepsy and what to do when one occurs....have any questiosn just email me at justinb182@yahoo.com
